The datestamp on the Registrar's message issuing RIPO77 was Mon, 6 Sep 1999 09:19:27 +0100 (BST). Therefore, proposal 3902 took effect almost 9 minutes before Registrar Michael issued the PO. Thus, the amended form of rule 1686 was in effect. The penalty for Failing to Report, as specified in the new rule 1686, is the same as a class D crime. However, ASoMBNoP eliminated letter-class crimes. Therefore, no penalty can be assessed against Murphy, since there is no penalty that is the same as a nonexistant definition. ====================================================================== Evidence attached by the Caller: Exhibit A: The header from the Assessor's report on proposal 3902 ----------------------------------------------------------------- >From owner-agora-official@gecko.serc.rmit.edu.au Mon Sep 06 02:31:34 1999 Received: from [131.170.42.16] by hotmail.com (2.1) with ESMTP id MHotMailB99CD4F30014D820F3B683AA2A103ACB0; Mon Sep 06 02:31:34 1999 Received: (from majordomo@localhost) by gecko.serc.rmit.edu.au (8.8.5/8.8.5) id IAA26697 for agora-official-list; Mon, 6 Sep 1999 08:12:34 GMT Received: from fw.serc.rmit.edu.au (fw-in.serc.rmit.edu.au [131.170.42.1]) by gecko.serc.rmit.edu.au (8.8.5/8.8.5) with ESMTP id IAA26694 for ; Mon, 6 Sep 1999 08:12:32 GMT Received: (from mail@localhost) by fw.serc.rmit.edu.au (8.9.1/8.9.1) id SAA10693 for ; Mon, 6 Sep 1999 18:20:40 +1000 (EST) Received: from note.orchestra.cse.unsw.edu.au(129.94.242.29) by fw.serc.rmit.edu.au via smap (V2.1) id xma010689; Mon, 6 Sep 99 18:20:10 +1000 Received: From mozart With LocalMail ; Mon, 6 Sep 99 18:10:49 +1000 From: Malcolm Ryan To: Agora Official Date: Mon, 6 Sep 1999 18:10:49 +1000 Message-ID: <19990906181049.A22077@cse.unsw.edu.au> Subject: OFF: Assessor's Report for Proposals 3900-3903 Mail-Followup-To: Agora Official Mime-Version: 1.0 Content-Type: text/plain; charset=us-ascii X-Mailer: Mutt 0.93.2i Sender: owner-agora-official@gecko.serc.rmit.edu.au Precedence: bulk Reply-To: agora-discussion@gecko.serc.rmit.edu.au Exhibit B: Rule 376/4 --------------------- Rule 376/4 (Power=1) When Proposals Take Effect A Proposal which is Adopted takes effect at the time date- stamped on the first message sent by the Assessor to reach the Public Forum announcing the results of the voting on that Proposal.
